LETTER TO PROPERTY OWNER

PROPOSED SHORELINE CONSTRUCTION

 

In order to perform various activities relating to construction on Lake Livingston, it is necessary to meet the permit and license requirements of both the Trinity River Authority of Texas and the Corps of Engineers. This packet provides the necessary information for application under both systems. Enclosed are the necessary forms for your examination, execution, and return to this office.

The Trinity River Authority licenses are valid for one year and are renewable June 1st each year. For all structures except bulkheads (i.e., piers, ramps, etc.) a fee of .10 per square foot is charged. A license is issued for bulkheads, but no fees are charged; however, written authorization from the AUTHORITY must be obtained prior to construction.

Also enclosed is a copy of the Corps of Engineers General Permit No. 11442(09) sponsored by TRINITY RIVER AUTHORITY. Please read this material carefully. If the activity for which you are applying falls within the terms of the General Permit, simply fill out the form and submit it along with the AUTHORITY'S completed application form, a drawing of the proposed structure and a material list. If the activity being applied for does not fall within the terms of the General Permit (such as dredging, etc.), disregard the enclosed General Permit and contact the Corps of Engineers directly or the AUTHORITY for a copy of the application required for this scope of work. It is also necessary to complete our application and forward us a copy of the completed Corp application as well.

Hopefully, the enclosed forms and the information presented in this letter will give you the information needed for compliance with both systems. However, if we may be of further assistance, please contact our office.

Many people have contacted the AUTHORITY concerning the withdrawal of water from Lake Livingston for domestic irrigation purposes. In response, we have acquired authorization to sell up to 1/2 acre-foot (162,925 gallons) of water each year, per lot, for a fee of $50.00. Permit to expire December 31st of each year purchased. This water may be used for domestic irrigation purposes only and its use must be confined to a specific lot or tract. Each purchaser is responsible for supplying his own pump and distribution system.
