Applicant by the
making, executing and submitting of this application to the Trinity
River Authority of Texas, represents and
warrants that the proposed construction described in said application
is not in violation of or contrary to any deed restriction or
covenant running with the land relating to the addition or
subdivision, if any, in which the herein described lot, tract or
parcel of
land is situated, and agrees, that should such construction or use be
in violation of any deed restrictions or covenants running with
the land, this building license or authorization shall automatically
become void and of no effect without the necessity of any action
on the part of the Trinity River Authority of Texas. After license or
authorization is issued, applicant, his heirs, successors, and
assigns agree to conduct the licensed or authorized activities in the
manner and in accordance with the mandate set forth in the
rules and regulations of the Trinity River Authority of Texas
pertaining to such activities, and that any breach of any rules and
regulations shall automatically void the license or authorization and
any further activities by applicant, his heirs, successors, and
assigns shall be deemed in violation of the ordinances providing a
penalty for the failure to obtain a license or authorization for
the activities hereby granted.
Applicant, his heirs,
successors, and assigns agree to observe and abide by all applicable
Federal, State and local laws,
ordinances and regulations pertaining to the activities herein
licensed or authorized and nothing contained herein shall be
construed as alleviating the applicant, his heirs, successors, and
assigns of any responsibility to obtain any permit, license or other
approval required by any agency in connection with the activities
herein licensed or authorized.
The applicant, his
heirs, successors, and assigns shall INDEMNIFY AND HOLD HARMLESS the
Trinity River Authority of Texas for any
damages, costs and charges to which applicant, his heirs, successors,
and assigns may be subject or which applicant, his heirs,
successors, and assigns may have to pay by reason of any injury to any
person or property, or loss of life or property, suffered or
sustained by any person whatsoever arising out of activities here
licensed or authorized: applicant, his heirs, successors, and
assigns shall, at his own expense, assume the defense of all claims
and actions for damages arising out of any such injuries by
third persons, and shall pay all judgments that may be rendered on
such actions. The Authority does not take any responsibility for
protecting this property of the applicant, his heirs, successors, and
assigns, nor guarantee that said property will not be used by
other persons in the absence of applicant, his heirs, successors, and
assigns. It being expressly intended that the Authority assumes
no responsibility for the conduct of the activities herein licensed or
authorized which shall be at the sole risk of the applicant, his
heirs, successors, and assigns.
APPLICANT HAS BEEN
INFORMED AND UNDERSTANDS that the policy of the Trinity River
Authority of Texas requires a Joint Use
Agreement for proposed construction in the flowage easement areas and
for excavations in or beyond the flowage easement areas.
I certify that the
above information is true and correct and has been answered and
furnished to the best of my ability. Applicant,
his heirs, successors, and assigns further agree that the Trinity
River Authority of Texas has the sole right to regulate the level of
the water impounded in the Livingston Reservoir.
